Reaffirming the call of Human Rights Commission
For the Independent State of Papua New Guinea

This paper aims to draw clear level of advocacy aimed to pursue the call for Human Rights Commission for the Independent State of Papua New Guinea. Human Rights Convention is the most compressive and highest recognised International Standard.

It gives member states that capacity to be transparent, accountable and responsible in applications of mandatory powers given to govern sovereignty of state.

Through out history societies have recognised the basic dignity of the Human Being; the development of the concept of Human Rights places particular emphasis on the value of the individual and his or her rights against the society. In this context, Human Rights are considered inherent and inalienable, that is the birthright of all Human Being, not granted or bestowed by a sovereign and not capable of being taken away.

Philosophical ideas about the rights of man were reflected in 1776 American Declaration of Independence and the 1789 French Declaration on the rights of man and citizen.

The league of Nations, established after world war one was active in the protection of minorities and inhabitants of colonial territories of the defeated powers. The International Labour Organisation established in 1919 in recognition of the fact that Universal lasting peace can be established only if it is based on social justice; is concerned with the protection of workers rights.

The horrors of Second World War resulted in the acceptance of Human Rights as the cornerstone of the post-war international order.

The establishment of (UN) United Nation’s in 1945, introduced a period in which the promotion of respect for Human Rights and fundamental freedoms everywhere in the world has become a major concern of the International Community.

At its first session in 1947, the newly established UN Commission on Human Rights authorised a preliminary draft international bill of rights.

1. Universal Declaration of Human Rights (1948)
2. International Covenant on Economic, Social and Cultural Rights (1966)
3. International Covenant on Civil and Political Rights (1966)
4. First optional protocol to the International Covenant on Civil and Political Rights (1966)

The Universal Declaration of Human Rights (UNHR) although not a legally binding treaty, is regarded as the most fundamental expression of International Human Rights Standards. It was proclaimed by the UN General Assembly as a Common Standard of achievement for all people’s and all Nation’s.

The UNHR is regarded as an authoritative interpretation of the Human Rights provision of the UN charter. It has been the basic source of subsequent international standards elaborated to protect and promote Human Rights. It has become a yardstick by which the degree of countries’ compliance with International Human Rights Standard is measured.


The 1948 UNHR encompasses two major categories of Human Rights, Civil and Political rights and Economic and Social and Cultural Rights.

 Civil and Political Rights are concerned to protect the individual from arbitrary exercise of power by the state.

 Economic, Social and Cultural Rights are concerned with the economic, social and cultural wellbeing of a person.

The Paris Principles in 1993 draws a clear road map for member states of UN to establish Human Rights Commission.

The Independent state of Papua New Guinea since joining the United Nation’s has so far signed and ratified 26 Convention as of 2006, the ratification of those instruments are only concerning specific issues. 10 instruments are in specific issues, while 16 other instruments are related to the protections of Particular groups.

All this instruments reflected Human Rights values but the actual signing and ratification of UN Human Rights Convention and establishment of the Commission would strengthen all those instruments with much international exposure of the state administration of its vested Power by people.


Why Human Rights Commission?


A commitment taken by Papua New Guinea Government will build a society in which political rights are reinforced through mechanisms of popular participation, economic rights are attended through development and capitalization programmes; and social as well as cultural rights are fulfilled through the equitable distribution of Education, Health, Housing and Social services.

This multi-cultural and multi-ethic society of ours; where differences in colour, religion or region are a source of unity and not of separation.

Sustained development is the best guarantee of Human Rights for Papua New Guineans now and for future generation.
Human Rights Commission plays a role of preventive system in solving certain issues of grave concern in our society; like all others striving to co solidifying democracy and with this co solidification of democracy in our country despite structural administrative problems in the past; I would rather call for our Government to observe Human Rights as its Highest priority.

In this Globalization era, Multi- National Companies are the source of dictating monopolist power determining Political, Social and Economical life of states. We as a developing Nation must attain to the International Standard practices that can enable progressive development do not violate our rights as people.


Human Rights Commission as an independent agency given the powers to investigate and prosecute under Human Rights treaties in respect with the national Constitution and Law; which a binding in nature upon signing and ratification I believe it will also enable and strengthen the capacity of state institutions like the Law and Justice sector including Ombudsman Commission to perform more broadly on global matters. . I therefore would like to call upon PNG Government to take action on the commitment it had made to Asia Pacific Human Rights Forum for 6 consecutive times.

David Ephraim is a young person with great vision to help empower people he meets during his interactions. In 2006-2008 Mr. Ephraim played a major role as the Pacific Youth Representative within the Technical Working Committee in drafting the Education for Sustainable Development Frame Work and Action Plan for the Pacific under UNESCO, Pacific office Apia, Samoa and leading regional agencies like PIF, SPC and leading regional education experts.
In August 2007, Mr. Ephraim attended the 8th International Congress on AIDS in Asia Pacific in Colombo, Sri Lanka as the Co/Chair of Asia Pacific Youth and HIV forum and one of the Youth Rapporteur for Youth Discussions. During the drafting of the National Strategic Plan on HIV-AIDS in PNG in 2003-2004 Mr. Ephraim was one of youth representative on care and support to persons’ living with HIV-AIDS.

In November to December 2007, Mr. Ephraim attended the 17th annual Human Rights and People’s Diplomacy training for human rights defenders under the Diplomacy Training Program of University of New South Wales, Faculty of Law a program established by 1996 Nobel Peace Price co-Laureate Jose Ramos-Horta now President of Timor Lester.

Mr. Ephraim has also participated in number international and national consultations on policy developments including research on issues affecting PNG and the Pacific. He is one of the active member to number of International NGO’s –GYCA- Asia Pacific, Amnesty International USA, Youth for Human Rights USA, UN Youth Delegates, UN Youth Delegates Asia Pacific, ASEAN Youth Leadership Forum- E-Consultations and many more Internet Based groupings.

David Ephraim runs a regional blog called Destiny Asia Pacific an online network of great people from Asia Pacific and other parts of the world. Destiny Asia Pacific aims to enable sharing of ideas and expertise in promoting dialogue between members and interested persons to take lead role in developing and implementing concepts that can change their societies.
